Legal Basis for Deed Restrictions in Lake Vista

All lands reclaimed by the Board of Levee Commissioners Orleans Levee District as authorized by Act 292 of the Louisiana Legislature of 1928 as incorporated into the Louisiana Constitution of 1921 were subject to a servitude restriction that not less than 30% of the lands reclaimed would be reserved for recreational uses forever.

Each property purchased in Lake Vista had a set of restrictions incorporated into and made part of the deed.  In some cases Title Search companies have failed to provide buyers with these restrictions.  An example can be found here.

Lake Vista Building Restrictions are servitudes running with the land.  Lake Vista Zoning - Permitted land use in Lake Vista, 30% maximum lot coverage, required setbacks, fencing, and other restrictions that are part of the Lake Vista Building Restrictions, were incorporated into the City's Comprehensive Zoning Ordinance under the Lake Vista chapters of the Lake Area Zoning Ordinance on October 18, 2007.

Fencing restrictions in Lake Vista are now part of the City's Zoning Ordinance.  Article 9A, covers the LAKE AREA ZONING DISTRICTS and Sections 9A.2. & 9A.4 specifically refer to Lake Vista, covering the following topics: Purpose of the District; Uses Authorized in the District; Permitted Uses; Accessory Uses; Conditional Uses; Permitted Signs; and Height, Area and Yard Requirements.
